Ear bite accused is found not guilty

Alexander Anderson is scarred for life, but the man accused of assaulting him, James Smith, walked free from Hamilton Sheriff Court after a three-day trial.

A jury found Smith (58), of Wallace Wynd, Law, not guilty of the attack in Netherton Street on May 3 last year.

The court heard Mr Anderson lost a two-inch chunk of his left ear and also sustained a cut behind his ear. It was alleged he was also punched repeatedly.

However, Smith claimed he acted in self defence after Mr Anderson attacked him and another man, John Kelly, with a spade

Records from Wishaw General Hospital showed that Smith was treated for bites and Mr Kelly also suffered injuries.
