A spokesperson for the Crown Office added: “The procurator fiscal has received a report concerning a 52-year-old man in connection with an alleged incident said to have occurred on September 18, 2016.

“The report remains under consideration.”

Scottish Labour confirmed that the councillor has been suspended from the party and the council group.

The council said it had been made aware of the matter.

A spokesman said: “The council has been informed that Councillor Burns has been suspended by his party, and the council leader has advised that Councillor Burns will cease to represent the Labour party on the council while he is suspended.”

The former civil servant, who sits on various committees including social work, planning, recruitment and housing and is a member of the NHS Lanarkshire board, is expected to appear in court next month.
