Overburns Quarry fight will go to Court of Session

THE final chapter of the Overburns Farm quarry saga is almost here as Patersons takes its fight to the Court of Session in Edinburgh.

x The company will start legal proceedings later this month against the Scottish Government and South Lanarkshire Council over Scottish Government Reporter David Buylla’s decision to uphold the council’s decision to reject Patersons’ application to extract sand and gravel from the Overburns site, near Lamington.

The company had planning applications rejected by the council in 2010 and 2012 before the Reporters’ decision in January of this year.

Legal proceedings will be heard in the Court of Session’s Inner House in front of three judges.

Proceedings will be heard on November 21 and 22 with both the Scottish Government and SLC being represented.

Members of the Clyde River Action Group (CRAG), who have fought Patersons every step of the way since the plans were first announced back in 2009, will be in court.

Clydesdale MSP Aileen Campbell urged Patersons to accept defeat gracefully,

“The firm’s applications have been consistently rejected by the community, South Lanarkshire Council and latterly, by the Reporter. Yet Patersons continues to refuse to accept it,” she said.

“Crucially, the local community overwhelmingly opposed the plans and the Clyde River Action Group has led an evidence-based, determined and coordinated campaign against the proposals. I do hope the Court of Session is Paterson’s last port of call.

“And that the company finally accepts the outcomes of the planning process and crucially and the will of the people.”
