A furious row has emerged in the East Renfrewshire Council elections following a candidate's allegation he has been threatened with possible legal action.

The David versus Goliath fight, as it’s been referred to, involves independent candidate David Jesner, who is standing in Newton Mearns North and Neilston and the council’s chief executive and returning officer Lorraine McMillan.

Mr Jesner complained about an image released by the council which he, among several other candidates felt breached purdah rules.

In an e-mailed response this week, Ms McMillan claimed comments he made are defamatory and that she is considering what further action to take on the matter.

Mr Jesner said: “I was shocked at the returning officer, both organising and participating in a photograph which clearly broke the rules of Purdah.

“However, I was devastated by this latest development. Four other candidates similarly complained, three received a different response while one is still waiting.

“Only swift action by the Electoral Commission can restore any level of confidence to the electoral system in East Renfrewshire.”

A spokesperson for the Electoral Commission refused to offer any comment on the communication between Ms McMillan and Mr Jesner.

An East Renfrewshire Council spokesman said: “It is not appropriate for the returning officer or council to comment on any matters relating to individual candidates.”
