Trading Standards take action against Mossend builder

A Facebook page was set up by disgruntled customers of Brando Building Contractors

Kevin Doyle, trading as Brando Building Contractors, has been served a court order under the Enterprise Act 2002 to protect the interests of consumers.

Trading Standards received a number of complaints about Mr Doyle including his failure to provide cancellation rights, failure to exercise the requisite level of skill and care of a reasonably competent builder, and failure to carry out work within the time agreed, or at all.

As all attempts by trading standards to consult with Mr Doyle and persuade him to resolve the complaints and to trade fairly proved fruitless, the authority had no alternative but to go to court and seek an enforcement order under the Enterprise Act.

The Order forbids Mr Doyle from undertaking any commercial practice without providing cancellation rights in circumstances where they apply, failing to take reasonable care and skill, or breaching contracts with consumers.

This order applies to Mr Doyle and any future business of his, operating across the country.

Any subsequent breach of an enforcement order can result in contempt of court proceedings with penalties of unlimited fines and or, imprisonment.

This is the second such order obtained by the Trading Standards service in North Lanarkshire after one was issued against John Donnelly of Airdrie in February.

Trading standards manager Paul Bannister said: “In general complaints of this nature are resolved following advice to the business concerned.

“Unfortunately in some cases a business will fail to co-operate and comply with their legal obligations and in such circumstances we will not hesitate to take formal action to ensure that the interests of consumers are protected.”
