Mum returns to Malta in custody battle for son

Janice Dunn (41) from Barrhead says that claims made by her ex that she abducted their son Frazer is complete and utter nonsense.

The mum was ordered back to the Mediterranean island after European law chiefs ruled that she had abducted the four-year-old.

The child’s father Daniel Borg-Olivier launched his legal bid when Janice returned to Scotland with Frazer after the collapse of their relationship.

Now she has been forced to leave her Barrhead home and return to Malta for fear of falling foul of the law and making the situation even worse.

She said: “I’ve done what the courts have asked. This was not a case of child abduction, like his father claims.

“The fact is he abandoned Frazer at the age of two. This is a personal vendetta against me. If he wanted to help Frazer, he would do what’s best.

“Also, in 16 months, he’s paid maintenance twice. We get no financial assistance from him or his family.

Janice was stunned when, earlier this year, she received a summons from the European Court of Justice insisting she return to the island to face court proceedings. She fought the case at the Court of Session but was shocked that a judge agreed with the order and told her she must take her son back.

Janice said: “Frazer’s been traumatised by what’s happened. He doesn’t know what’s going on and why he’s in Malta in a hotel instead of playing with his nursery friends in Scotland.

“He screams and refuses to go with his father and I have had to involve the police on more than one occasion.

“He considers Scotland his home. He cries all the time and keeps on asking when we’re going home. Frazer is the victim in all this. We’re living in a budget hotel room and only have two suitcases of clothes.

Borg-Olivier, who runs satellite TV business denied Janice’s claims that he had abandoned Frazer and not paid maintenance.

He said: “I never missed payments. I’ve got proof that I paid her. At the end of the day, the court has to decide.

“She moved abroad without informing me. Janice is using our child to go against me, which I don’t like. This is not fair. Why put a child against his father?“I don’t know why she’s staying in a hotel instead of renting an apartment or why she can’t find a job. There are plenty of jobs in Malta.

Janice’s lawyer Sarah Chirobeck said: “I believe, based on previous cases, that we have grounds for success. However, we haven’t heard yet the father’s version of events and evidence.”
